Terms of Service

You confirm that you are at least 13 years old, or at least 16 years old in the European Economic Area. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian. By using the Service you represent that you meet these requirements and that any registration information you provide is accurate.

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate account information and keep it up to date.
• Notify us promptly at info@hausofaxion.ca if you suspect unauthorised use of your account.
• You may hold one account per role (client or trainer). Accounts are personal and may not be sold or transferred.

Haus of Axion is a fitness coaching and tracking platform. It does not provide medical advice, diagnosis, or treatment. Content available through the Service — including workout plans, nutrition estimates, and AI-generated meal, workout, and progress analyses — is approximate and informational only.

Always consult a qualified health professional before starting a new fitness or nutrition programme, especially if you have a medical condition, are pregnant, or are recovering from injury. You use the Service and undertake any physical activity at your own risk.

The Service includes AI-powered features (meal photo analysis, AI workout suggestions, progress analysis, and trainer CRM insights) powered by third-party AI providers, currently Google Gemini. When you use these features:

• The content you submit (photos, text) is transmitted to the AI provider for processing, as described in our Privacy Policy.
• AI output is an estimate. It may be inaccurate or incomplete and is not medical, dietetic, or professional advice.
• AI usage is subject to the request limits of your subscription tier and may be supported by advertising on free tiers.
• You can avoid AI processing entirely by not using AI-powered features.

Personal trainers listed on the Haus of Axion marketplace are independent professionals. Haus of Axion is not the trainer’s employer, does not supervise training sessions, and is not responsible for the conduct, quality, or outcome of sessions or services delivered by trainers. Any agreement for personal training services is between you and the trainer.

Trainers are responsible for holding the certifications, insurance, and qualifications required for the services they offer, and for the accuracy of the credentials they present on the Service.

• Subscriptions purchased in the app are billed by Apple through the App Store or Google through Google Play and are managed through your store account. Subscription entitlements are administered via RevenueCat.
• Payments for training services (for example, session fees or monthly coaching bills) are processed by Stripe. Trainer payouts are handled through Stripe Connect.
• Cancellation and refund rights follow the policies of the platform used for the purchase (App Store, Google Play, or Stripe). Store subscriptions must be cancelled through your store account; cancelling in-app does not cancel a store subscription.
• Prices and tier features may change. Material changes will be communicated in advance where required by the applicable store policies or by law.
• Free tiers are supported by advertising served through Google AdMob, and certain AI features may be unlocked by watching rewarded ads.

You retain ownership of the content you submit to the Service, including chat messages, progress photos, meal photos, and profile information (“Your Content”). You grant Haus of Axion a limited, non-exclusive licence to host, store, process, and display Your Content solely to operate and improve the Service.

Your Content may be processed by our backend, by third-party AI providers (currently Google Gemini), and by trainers you have explicitly assigned to your account. See the Privacy Policy for complete details about how your information is handled.

You are responsible for Your Content. Do not submit content that is unlawful, infringing, harassing, or that you do not have the right to share. We may remove content or suspend accounts that violate these Terms.

• Do not use the Service for any unlawful purpose or in violation of App Store or Google Play policies.
• Do not harass, abuse, or harm other users, including via in-app chat.
• Do not attempt to gain unauthorised access to the Service, other users’ data, or our systems.
• Do not scrape, resell, reverse engineer, or interfere with the operation of the Service.
• Do not circumvent subscription entitlements, AI usage limits, or advertising.

The Service, including its software, design, branding, and content we create, is owned by Haus of Axion Inc. or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

• You may stop using the Service at any time and may delete your account in-app via Settings → Delete Account, or by emailing info@hausofaxion.ca.
• Deletion of your data after account deletion follows the retention periods described in the Privacy Policy.
• We may suspend or terminate accounts that violate these Terms, create risk for other users, or as required by law. Where reasonable, we will notify you of the reason.
• Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) survive.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the maximum extent permitted by law, Haus of Axion Inc. and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service — including injuries sustained during training activities or reliance on AI-generated content. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid to Haus of Axion in the 12 months before the claim arose and (b) CAD $100. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold harmless Haus of Axion Inc. from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any mandatory consumer protection rights in your jurisdiction, disputes will be resolved in the courts of Ontario, Canada. Nothing in this section deprives you of protections available under the consumer laws of your place of residence.

We may update these Terms as the Service evolves. For material changes, we will update the date above and, where feasible, notify you by email or an in-app notice. Continued use after the effective date constitutes acceptance of the revised Terms.
